1. Anyone who, during an armed conflict, carries out or orders the carrying out of any of the following actions shall be punished with imprisonment for four to six years:

a) Attacks or reprisals against cultural property or places of worship that constitute the cultural or spiritual heritage of peoples, provided that such property or places are not situated in the immediate vicinity of a military objective or are not used in support of the adversary's military effort and are duly marked;

b) Improper use of the cultural property or places of worship referred to in subparagraph a) in support of a military action;

c) Large-scale appropriation, theft, looting, or acts of vandalism against the cultural property or places of worship referred to in subparagraph a);

d) Attacks or reprisals against civilian property of the opposing party, causing its destruction, provided that this does not, in the circumstances of the case, offer a definite military advantage or that such property does not effectively contribute to the adversary's military action;

e) Attack, destroy, seize, or render useless property indispensable to the survival of the civilian population, unless the adverse party uses such property in direct support of military action or exclusively as a means of subsistence for members of its armed forces;

f) Attack or retaliate against works or installations containing dangerous forces, where such attacks may result in the release of those forces and consequently cause significant losses among the civilian population, unless such works or installations are used in regular, substantial, and direct support of military operations and such attacks are the only feasible means of ending such support;

g) Destroy, damage, or seize, without military necessity, property not belonging to you, compel another to hand it over, or commit any other acts of pillage;

h) Improperly or unnecessarily seizes movable or immovable property in occupied territory or destroys or captures a non-military ship or aircraft and its cargo belonging to an adverse or neutral party, in violation of international rules applicable to armed conflicts at sea;

i) Attacks or commits acts of hostility against the installations, equipment, units, private residence, or vehicles of any member of the personnel referred to in paragraph 10 of Article 612, or threatens such attacks or acts of hostility to compel a natural or legal person to perform or refrain from performing any act.

2. When the attack, reprisal, act of hostility, or improper use is directed against cultural property or places of worship under special protection or to which protection has been conferred under special agreements, or immovable cultural property or places of worship under enhanced protection or their immediate surroundings, the next higher penalty may be imposed.

In the other cases provided for in the previous section of this article, the higher penalty may be imposed when extensive and significant destruction is caused to the property, works or facilities on which they fall or in cases of extreme seriousness.
