The penalty established in the preceding article shall be applied in its upper half when any of the following circumstances are present:
1. That the perpetrator is the custodian or has knowledge of the secret or information by reason of their position or assignment.
2. That the disclosure consists of publicizing the secret or information in any means of social communication or in a way that ensures its dissemination.
