Article 578 [source]

Spanish Criminal Code
English translation

1. Public glorification or justification of the crimes covered by Articles 572 to 577, or of those who have participated in their commission, or the performance of acts that entail discrediting, belittling, or humiliating the victims of terrorist crimes or their families, shall be punished with imprisonment for one to three years and a fine of twelve to eighteen months. The judge may also order in the sentence, for a period of time that he or she specifies, one or more of the prohibitions provided for in Article 57.

2. The penalties provided for in the preceding paragraph shall be increased by half when the acts have been carried out through the dissemination of services or content accessible to the public through the media, the internet, or by means of electronic communications services or through the use of information technologies.

3. When the acts, in light of their circumstances, are likely to seriously disrupt public peace or create a grave sense of insecurity or fear in society or a part thereof, the penalty shall be imposed in its upper half, which may be increased to the next higher degree.

4. The judge or court shall order the destruction, erasure, or disabling of the books, files, documents, articles, or any other medium by means of which the crime was committed. When the crime was committed through information and communication technologies, the removal of the content shall be ordered. If the acts were committed through services or content accessible via the internet or electronic communications services, the judge or court may order the removal of the unlawful content or services. Alternatively, the court may order hosting service providers to remove illegal content, search engines to remove links to such content, and electronic communications service providers to block access to illegal content or services, provided that one of the following conditions is met:

a) When the measure is proportionate to the seriousness of the facts and the relevance of the information and necessary to prevent its dissemination.

b) When the content referred to in the preceding paragraphs is disseminated exclusively or predominantly.

5. The measures provided for in the preceding paragraph may also be ordered by the investigating judge as a precautionary measure during the investigation of the case.
