Spanish Criminal Code
English translation

1. In the cases provided for in this Chapter and the following one, the judges or courts shall order the dissolution of the organization or group and, where applicable, any other consequences set forth in Articles 33.7 and 129 of this Code.

2. Those responsible for the conduct described in the two preceding articles shall also be subject to special disqualification from all economic activities or legal transactions related to the activity of the criminal organization or group or to their participation within it, in addition to the penalties provided for therein, for a period of between six and twenty years longer than the term of imprisonment imposed, if any, taking into account the seriousness of the crime, the number of crimes committed, and the circumstances of the offender. In any case, when the conduct described in these articles is covered by another provision of this Code, the provisions of Rule 4 of Article 8 shall apply.

3. The provisions of this Chapter shall apply to any criminal organization or group that carries out any criminally relevant act in Spain, even if they were established, are based, or carry out their activities abroad.

4. Judges or courts, stating their reasons in the judgment, may impose a penalty one or two degrees lower on the person responsible for any of the offenses described in this Chapter, provided that the person has voluntarily abandoned their criminal activities and has actively cooperated with the authorities or their agents, either to obtain decisive evidence for the identification or capture of other perpetrators or to prevent the operation or development of the organizations or groups to which they belonged, or to prevent the commission of an offense that was to be committed within or through said organizations or groups.
