Any public authority or official who, in a criminal case, orders, carries out or prolongs the incommunicado detention of a detainee, prisoner or sentenced person, in violation of the time limits or other constitutional or legal guarantees, shall be punished with the penalty of special disqualification from employment or public office for a period of two to six years.
