The next higher penalty will be imposed, in the respective cases, if the offender is a public official in charge of the custody or escort of a convicted, imprisoned, or detained person. The official will also be punished with special disqualification from public employment or office for six to ten years if the fugitive has been convicted by a final judgment, and with special disqualification from public employment or office for three to six years in all other cases.
