1. Anyone who, being able to do so through their immediate intervention and without risk to themselves or others, fails to prevent the commission of a crime affecting a person's life, physical integrity, health, liberty, or sexual freedom, shall be punished with imprisonment for six months to two years if the crime is against life, and with a fine of six to twenty-four months in other cases, unless the crime not prevented carries an equal or lesser penalty, in which case the penalty shall be one degree lower than that of the crime.

2. The same penalties shall apply to anyone who, being able to do so, fails to assist the authorities or their agents to prevent a crime of those provided for in the preceding paragraph, and of whose imminent or current commission they have knowledge.
