1. The same penalty stipulated in the preceding article shall apply to any judge, magistrate, or court clerk guilty of malicious delay in the administration of justice. Malicious delay shall be understood as any delay caused to achieve any illegitimate purpose.
2. When the delay is attributable to an official other than those mentioned in the preceding paragraph, the penalty indicated shall be reduced by half.
