1. Any public official or employee who sexually solicits a person who, for themselves or for their spouse or another person with whom they have a stable relationship of similar affection, ascendant, descendant, sibling (by blood, adoption, or affinity in the same degrees), has claims pending resolution by said official or on which they must issue a report or submit a consultation to their superior, shall be punished with imprisonment for one to two years and absolute disqualification from holding public office for a period of six to twelve years.
2. Any official of Penitentiary Institutions, juvenile protection or reform centers, immigration detention centers, or any other detention or custody center, including temporary stay centers, who sexually solicits a person under their care shall be punished with imprisonment for one to four years and absolute disqualification from holding public office for a period of six to twelve years.
3. The same penalties shall apply when the person sought is an ascendant, descendant, sibling (by blood or adoption), or relative by marriage in the same degrees as the person under their guardianship. These penalties shall also apply when the person sought is the spouse of a person under their guardianship or is in a stable relationship with that person in a similar relationship of affection.
