Any public official who uses a secret acquired by reason of their office or position, or privileged information, with the intent to obtain an economic benefit for themselves or a third party, shall be subject to a fine of one to three times the amount of the benefit sought, obtained, or facilitated, and special disqualification from public employment or office and from exercising the right to passive suffrage for a period of two to four years. If the intended benefit is obtained, the penalties shall be imprisonment for one to three years, a fine of one to six times the amount of the benefit sought, obtained, or facilitated, and special disqualification from public employment or office and from exercising the right to passive suffrage for a period of four to six years.

If serious harm results to the public interest or to a third party, the penalty shall be imprisonment for one to six years and special disqualification from public employment or office and from exercising the right to passive suffrage for a period of nine to twelve years. For the purposes of this article, privileged information is understood to mean any specific information that is held exclusively by reason of the office or public position and that has not been notified, published or disclosed.
