Any public official or authority who, abusing their position, commits any crime of fraud or defrauding of benefits of the Social Security System of article 307 ter, shall incur the penalties respectively indicated to these, in their upper half, which may reach the higher degree, and special disqualification for employment or public office and for the exercise of the right of passive suffrage for a period of three to nine years, unless the facts are punished with a more serious penalty in some other provision of this Code.
