Any public official who, without intent to misappropriate, uses public property entrusted to them by reason of or in connection with their duties, shall be subject to imprisonment for six months to three years and suspension from public employment or office for one to four years.
If the offender fails to return the misappropriated public property within ten days of the commencement of proceedings, the penalties stipulated in the preceding article shall apply.
