When the acts sanctioned in Articles 379, 380, and 381 result in, in addition to the prevented risk, a harmful outcome constituting a crime, regardless of its severity, the Judges or Courts shall only consider the most seriously punishable offense, applying the penalty in its upper half and, in all cases, ordering compensation for any resulting civil liability.
When the harmful outcome coincides with a crime under Article 381, the penalty of disqualification from driving motor vehicles and mopeds provided for in this article shall in all cases be imposed in its upper half.
