The penalty shall be increased by one or two degrees from that specified in Article 368 when:
1. Minors under 18 years of age or persons with mental disabilities are used to commit these offenses.
2. The perpetrators are the leaders, administrators, or managers of the organizations referred to in circumstance 2 of paragraph 1 of Article 369.
3. The conduct described in Article 368 is of extreme gravity.
Cases are considered extremely gravity when the quantity of the substances referred to in Article 368 significantly exceeds that considered to be of considerable importance, or when ships, vessels, or aircraft have been used as a specific means of transport, or when the aforementioned conduct has been carried out by simulating international trade operations between companies, or when international networks are dedicated to this type of activity, or when three or more of the circumstances provided for in Article 369.1 are present.
In the cases referred to in points 2 and 3 above, the guilty parties will also be fined from one to three times the value of the drug involved in the crime.
