Anyone who, knowing that a product is counterfeit or altered, imports, exports, advertises, offers, displays, sells, facilitates, dispenses, dispatches, packages, supplies (including intermediation), traffics, distributes, or places on the market any of the medicines, active substances, excipients, health products, accessories, elements, or materials referred to in the preceding article, thereby creating a risk to the life or health of individuals, shall be punished with imprisonment for six months to four years, a fine of six to eighteen months, and special disqualification from practicing a profession or trade for one to three years.
The same penalties shall be imposed on anyone who acquires or possesses such products for the purpose of distributing them for public consumption, use by third parties, or any other use that may affect public health.
