1. The acts referred to in the preceding article shall be punished with a prison sentence of three to six years and a fine of eighteen to twenty-four months when the fire reaches a particularly serious level, given the presence of any of the following circumstances:

1. That it affects a considerable area.

2. That it causes significant or serious erosion of the soil.

3. That it significantly alters the living conditions of animals or plants, or affects a protected natural area.

4. That the fire affects areas near population centers or inhabited places.

5. That the fire is started at a time when weather or terrain conditions significantly increase the risk of its spread.

6. In any case, when it causes serious damage or destruction to the affected resources.

2. The same penalty shall be imposed when the perpetrator acts to obtain an economic benefit from the effects of the fire.
