1. Those who, in the manufacture, handling, transport, possession, or sale of explosives, flammable or corrosive substances, toxic and asphyxiating substances, or any other materials, devices, or contraventions that may cause widespread damage, violate established safety regulations, thereby endangering the life, physical integrity, or health of persons, or the environment, shall be punished with imprisonment for six months to three years, a fine of twelve to twenty-four months, and special disqualification from public employment or office, profession, or trade for a period of six to twelve years. The same penalties shall be imposed on anyone who illegally produces, imports, exports, sells, or uses ozone-depleting substances.
2. Those responsible for the surveillance, control, and use of explosives that could cause widespread damage, who, in contravention of regulations on explosives, have facilitated their actual loss or theft, shall be punished with imprisonment for six months to three years, a fine of twelve to twenty-four months, and special disqualification from public employment or office, profession, or trade for six to twelve years.
3. In the cases covered in the preceding paragraphs, when a legal entity is responsible for the acts in accordance with the provisions of Article 31 bis of this Code, it shall be subject to a fine of one to three years, unless, once the damage caused has been proven, its amount is greater, in which case the fine shall be double to quadruple the amount of said damage.
Subject to the rules established in Article 66 bis, judges and courts may also impose the penalties set forth in subparagraphs b) through g) of paragraph 7 of Article 33.
The penalties established in the preceding paragraphs shall be increased by half when the offender is the director, administrator, or manager of the company, business, organization, or operation.
4. Those responsible for factories, workshops, means of transport, depots, and other establishments related to explosives that may cause widespread damage shall be punished with imprisonment for six months to one year, a fine of six to twelve months, and special disqualification from public employment or office, profession, or trade for a period of three to six years when they engage in any of the following conduct:
a) Obstructing the Administration's inspection activities regarding explosives safety.
b) Falsifying or concealing relevant information from the Administration regarding compliance with mandatory safety measures related to explosives.
c) Disobeying the express orders of the Administration aimed at rectifying the serious anomalies detected in matters of explosives safety.
