1. Anyone who, through the discharge, emission, or introduction into the air, soil, or water of any quantity of ionizing materials or radiation, or by any other means of exposure to such radiation, endangers the life, physical integrity, health, or property of one or more persons, shall be punished with imprisonment for six to twelve years and special disqualification from public employment or office, profession, or trade for a period of six to ten years. The same penalty shall be imposed when this conduct endangers the quality of the air, soil, or water, or animals or plants.
2. When, as a result of the conduct described in the preceding paragraph, in addition to the prevented risk, a harmful result constituting a crime occurs, regardless of its severity, the judges or courts shall consider only the most seriously punishable offense, applying the penalty in its upper half.
3. When, in accordance with the provisions of Article 31 bis, a legal entity is responsible for the crimes set forth in this article, it shall be subject to a fine of two to five years.
Subject to the rules established in Article 66 bis, judges and courts may also impose the penalties set out in letters b) through g) of paragraph 7 of Article 33.
