1. Anyone who hunts or fishes for species other than those indicated in the previous article, when expressly prohibited by the specific rules on their hunting or fishing, shall be punished with a fine of eight to twelve months, special disqualification from exercising the right to hunt or fish for a period of two to five years and deprivation of the right to possess and carry weapons for the same period.

2. Anyone who hunts, fishes, or carries out relevant shellfish harvesting activities on species other than those indicated in the previous article on public or private land belonging to others, subject to a special hunting regime, without the due permission of its owner or subject to a shellfish or aquaculture concession or authorization without the due enabling administrative title, shall be punished with a fine of four to eight months and special disqualification from exercising the right to hunt, fish, or carry out shellfish harvesting activities for a period of one to three years and deprivation of the right to possess and carry weapons for the same period, in addition to the penalties that may correspond to him, where appropriate, for the commission of the crime provided for in paragraph 1 of this article.

3. If the above conduct causes serious damage to the hunting heritage of land subject to a special hunting regime or to the sustainability of resources in areas of concession or authorization for shellfish or aquaculture, a prison sentence of six months to two years and special disqualification for the exercise of the rights to hunt, fish, and carry out shellfish activities for a period of two to five years and deprivation of the right to possess and carry weapons for the same period will be imposed.
