1. Anyone who, in contravention of the law or other general provisions, cuts, fells, uproots, collects, acquires, possesses, or destroys protected species of wild flora, or traffics in them, their parts, derivatives thereof, or their propagules, unless the conduct affects an insignificant number of specimens and has no relevant consequences for the conservation status of the species, shall be punished with imprisonment for six months to two years or a fine of eight to twenty-four months, and special disqualification from practicing a profession or trade for a period of six months to two years. The same penalty shall be imposed on anyone who, in contravention of the law or other general provisions, destroys or seriously alters their habitat.

2. The penalty shall be imposed in its upper half if the species or subspecies in question are listed as endangered.

3. If the acts were committed through gross negligence, a prison sentence of three months to one year or a fine of four to eight months will be imposed, and special disqualification from profession or trade for a period of three months to two years.
