The acts referred to in the three preceding articles shall be punished with the next higher penalty, without prejudice to any penalties that may apply under other provisions of this Code, when any of the following circumstances are present in the commission of any of the acts described in the preceding article:
a) That the industry or activity operates clandestinely, without having obtained the required authorization or administrative approval for its facilities.
b) That the express orders of the administrative authority to correct or suspend the activities specified in the preceding article have been disobeyed.
c) That information regarding the environmental aspects of the activity has been falsified or concealed.
d) That the inspection activity of the Administration has been obstructed.
e) That a risk of irreversible or catastrophic damage has occurred.
f) That illegal water extraction occurs during a period of restrictions.
