1. Those who, in contravention of the law or other general provisions, collect, transport, recover, transform, dispose of, or utilize waste, or fail to adequately control or monitor such activities, in a way that causes or may cause substantial damage to air, soil, or water quality, or to animals or plants, death or serious injury to persons, or that may seriously harm the balance of natural systems, shall be punished with the penalties provided for in the preceding article, in their respective cases.
2. Anyone who, outside the case referred to in the preceding paragraph, transports a significant quantity of waste, whether in the case of a single shipment or several related shipments, in any of the cases referred to in European Union law concerning waste shipments, shall be punished with a prison sentence of three months to one year, or a fine of six to eighteen months, and special disqualification from practicing a profession or trade for a period of three months to one year.
