1. Anyone who, with intent to profit and with knowledge of the commission of a crime against property or the socio-economic order, in which they have not participated as either a perpetrator or an accomplice, assists those responsible in profiting from the proceeds of the crime, or receives, acquires, or conceals such proceeds, shall be punished with a prison sentence of six months to two years.
A prison sentence of one to three years shall be imposed in the following cases:
a) When the goods in question are of artistic, historical, cultural, or scientific value.
b) When the goods in question are basic necessities, pipes, wiring, equipment, or components of electrical supply or telecommunications infrastructure, or other goods intended for the provision of services of general interest, agricultural or livestock products, or the instruments or means used to obtain them.
c) When the acts are of particular gravity, taking into account the value of the goods received or the damages that their theft would foreseeably have caused.
2. These penalties shall be imposed in their upper half on anyone who receives, acquires, or conceals the proceeds of a crime for the purpose of trafficking them. If the trafficking is carried out using a commercial or industrial establishment or premises, a fine of twelve to twenty-four months shall also be imposed. In these cases, the judges or courts, taking into account the seriousness of the act and the personal circumstances of the offender, may also impose on the offender the penalty of special disqualification from practicing their profession or industry for a period of two to five years and order the temporary or permanent closure of the establishment or premises. If the closure is temporary, its duration may not exceed five years.
3. In no case may a custodial sentence be imposed that exceeds that prescribed for the underlying crime. If the underlying crime is punishable by a penalty of another nature, the custodial sentence shall be replaced by a fine of twelve to twenty-four months, unless the underlying crime carries a penalty equal to or less than this. In such a case, the guilty party will be given the penalty for that crime in its lower half.
