The de facto or de jure directors of a company, whether already established or in formation, who falsify annual accounts or other documents that should reflect the legal or economic situation of the entity, in a manner likely to cause economic harm to the company, any of its shareholders, or a third party, shall be punished with imprisonment for one to three years and a fine of six to twelve months.

If economic harm is actually caused, the penalties shall be increased by half.
