1. Any manager, administrator, employee, or collaborator of a commercial enterprise or company who, directly or through an intermediary, receives, requests, or accepts an unjustified benefit or advantage of any nature, or an offer or promise to obtain it, for himself or for a third party, as consideration for improperly favoring another in the acquisition or sale of goods, or in the contracting of services or in commercial relations, shall be punished with imprisonment for six months to four years, special disqualification from the exercise of industry or commerce for a period of one to six years, and a fine of one to three times the value of the benefit or advantage.

2. The same penalties shall apply to anyone who, directly or through an intermediary, promises, offers, or grants to directors, administrators, employees, or collaborators of a commercial enterprise or company an unjustified benefit or advantage of any kind, for themselves or for third parties, as consideration for them to improperly favor the offender or a third party over others in the acquisition or sale of goods, contracting of services, or in commercial relations.

3. Judges and courts, taking into account the amount of the benefit or the value of the advantage, and the importance of the offender's duties, may impose a lesser penalty and reduce the fine at their discretion.

4. The provisions of this article shall apply, as appropriate, to the directors, administrators, employees, or collaborators of a sports entity, regardless of its legal form, as well as to athletes, referees, or judges, with respect to conduct intended to predetermine or deliberately and fraudulently alter the outcome of a sporting event, match, or competition of special economic or sporting significance.

For these purposes, a sporting competition shall be considered to be of special economic significance when the majority of participants receive any type of remuneration, compensation, or income for their participation in the activity; and a sporting competition of special sporting significance when it is classified in the annual sports calendar approved by the corresponding sports federation as an official competition of the highest category of the modality, specialty, or discipline in question.

5. For the purposes of this article, the provisions of Article 297 shall apply.
