Damages caused by gross negligence exceeding €80,000 will be punished with a fine of three to nine months, depending on the extent of the damage.
The offenses referred to in this article will only be prosecuted upon complaint by the injured party or their legal representative.
The Public Prosecutor's Office may also file a complaint when the injured party is a minor, a person with a disability requiring special protection, or a vulnerable person. In these cases, forgiveness by the injured party extinguishes the criminal action.
