1. A debtor who, being in a situation of actual or imminent insolvency, favors any creditor by carrying out an act of asset disposal or creating obligations intended to pay a debt that is not yet due or to provide a guarantee to which the creditor is not entitled, when such an operation lacks economic or business justification, shall be punished with imprisonment for six months to three years or a fine of eight to twenty-four months.

2. A debtor who, once the insolvency application has been admitted for processing, without being authorized to do so either judicially or by the insolvency administrators, and outside the cases permitted by law, carries out any act of asset disposal or creates obligations intended to pay one or more creditors, whether privileged or not, to the detriment of the others, shall be punished with imprisonment for one to four years and a fine of twelve to twenty-four months.
