1. Anyone who commits fraud by using electricity, gas, water, telecommunications, or other elements, energy, or fluids belonging to another, by any of the following means, shall be punished with a fine of three to twelve months:

1. By using mechanisms installed to carry out the fraud.

2. By maliciously altering meter readings or devices.

3. By employing any other clandestine means.

2. If the amount defrauded does not exceed 400 euros, a fine of one to three months shall be imposed.

3. When the fraud provided for in this article, whatever its amount, is committed for the purpose of supplying electricity to facilities used for the commission of any of the acts indicated in Article 368, a prison sentence of six to eighteen months or a fine of twelve to twenty-four months shall be imposed.
