1. Those who, to the detriment of another, appropriate for themselves or for a third party, money, goods, securities, or any other movable property that they have received in deposit, commission, or custody, or that has been entrusted to them by virtue of any other title that creates the obligation to deliver or return it, or who deny having received it, shall be punished with the penalties of Article 248 or, where applicable, Article 250, unless they are already punished with a more severe penalty under another provision of this Code.
2. If the amount appropriated does not exceed 400 euros, a fine of one to three months shall be imposed.
