Those who, with intent to profit, use sufficient deception to cause error in another, inducing them to perform an act of disposal to their own or another's detriment, commit fraud.
Those convicted of fraud shall be punished with imprisonment for six months to three years. In determining the sentence, the amount defrauded, the economic loss caused to the victim, the relationship between the victim and the perpetrator, the means employed by the perpetrator, and any other circumstances that serve to assess the seriousness of the offense shall be taken into account.
If the amount defrauded does not exceed 400 euros, a fine of one to three months shall be imposed, unless any of the circumstances of Article 250 apply. However, if the offender has been definitively convicted of at least three offenses of the same nature, included in this chapter, and at least one of them is a minor offense, the penalty provided for in the second paragraph of this article shall be imposed. Criminal records that have been cancelled or should be cancelled will not be taken into account.
