1. Anyone who takes or uses another person's motor vehicle or moped without proper authorization, without intent to appropriate it, shall be punished with community service for thirty-one to ninety days or a fine of two to twelve months, if they return it, directly or indirectly, within a period not exceeding forty-eight hours. In no case may the imposed penalty be equal to or greater than that which would apply if the person permanently appropriated the vehicle.
2. If the act is committed using force against property, the penalty shall be applied in its upper half.
3. If restitution is not made within the specified period, the act shall be punished as theft or robbery, as applicable.
4. If the act is committed with violence or intimidation against persons, the penalties of Article 242 shall be imposed in all cases.
