1. Anyone who, being the owner of a movable item or acting with the owner's consent, removes it from the person who legitimately possesses it, to the detriment of that person or a third party, shall be punished with a fine of three to twelve months.
2. If the value of the stolen item does not exceed 400 euros, the penalty shall be a fine of one to three months.
