1. Anyone who, with intent to profit, takes movable property belonging to another without the owner's consent shall be punished, as a perpetrator of theft, with a prison sentence of six to eighteen months if the value of the stolen goods exceeds 400 euros.
2. A fine of one to three months shall be imposed if the value of the stolen goods does not exceed 400 euros, unless any of the circumstances of Article 235 apply. However, if the offender has been definitively convicted of at least three offenses of the same nature, included in this Title, and at least one of them is a minor offense, the penalty provided for in paragraph 1 of this article shall be imposed.
Expunged or expunged criminal records shall not be taken into account.
3. The penalties established in the previous sections will be imposed in their upper half when, in the commission of the act, the alarm or security devices installed in the stolen items have been neutralized, eliminated or rendered useless by any means.
