1. Falsifying a birth shall be punished with imprisonment for a term of six months to two years.

2. The same penalty shall be imposed on anyone who conceals or hands over to third parties a person under eighteen years of age in order to alter or modify their parentage.

3. Substituting one child for another shall be punished with imprisonment for a term of one to five years.

4. Ascendants, by birth or adoption, who commit the acts described in the three preceding paragraphs may also be punished with special disqualification from exercising parental rights over the presumed, concealed, handed over, or substituted child or descendant, and, where applicable, over their other children or descendants, for a term of four to ten years.

5. The substitution of one child for another that occurs in healthcare or social care facilities due to gross negligence on the part of those responsible for their identification and custody shall be punished with imprisonment for a term of six months to one year.
