1. To prosecute the offenses set forth in this Chapter, a complaint from the aggrieved party or their legal representative is required.

2. The complaint required in the preceding paragraph is not necessary to prosecute the acts described in Article 198 of this Code, nor when the commission of the offense affects the general interest, a plurality of persons, or if the victim is a minor or a person with a disability in need of special protection.

3. Pardon by the offended party or their legal representative, as the case may be, extinguishes the criminal action without prejudice to the provisions of Article 130.1.5, second paragraph.
