Article 192 [source]

Spanish Criminal Code
English translation

1. Those sentenced to imprisonment for one or more offenses included in this Title shall also be subject to supervised release, which shall be served after the prison sentence. The duration of this measure shall be from five to ten years if any of the offenses is serious, and from one to five years if it involves one or more less serious offenses. In the latter case, when it involves a single offense committed by a first-time offender, the court may or may not impose supervised release, taking into account the lesser dangerousness of the offender.

2. Ascendants, guardians, curators, custodians, teachers, or any other person in charge, de facto or de jure, of a minor or person with a disability in need of special protection, who participate as perpetrators or accomplices in the commission of the offenses included in this Title, shall be punished with the corresponding penalty, increased by half.

This rule shall not apply when the circumstance contained therein is specifically contemplated in the relevant criminal offense.

3. The judicial authority shall impose on persons responsible for committing any of the offenses in Chapters I or V when the victim is a minor, and in all cases for any of the offenses in Chapter II, in addition to the penalties provided for in those Chapters, the penalty of deprivation of parental rights or special disqualification from exercising parental rights, guardianship, curatorship, custody, or foster care, for a period of four to ten years. Persons responsible for the remaining offenses in this Title may, with due justification, be subject to the penalties established for those offenses, in addition to the penalties specified for those offenses, the penalty of deprivation of parental rights or special disqualification from exercising parental rights, guardianship, curatorship, custody, or foster care, for a period of six months to six years, as well as disqualification from public employment or office or from practicing a profession or trade, whether paid or unpaid, for a period of six months to six years.

Furthermore, the judicial authority shall impose on persons responsible for the offenses covered by this Title, without prejudice to the penalties applicable under the preceding articles, a special disqualification from any profession, trade, or activity, whether paid or unpaid, that involves regular and direct contact with minors, for a period of between five and twenty years longer than the term of imprisonment imposed in the sentence if the offense is serious, and between two and twenty years if it is less serious. In both cases, proportionality shall be given to the seriousness of the offense, the number of offenses committed, and the circumstances of the convicted person.
