1. To prosecute the crimes of sexual assault and sexual harassment, a complaint from the victim, their legal representative, or a formal accusation from the Public Prosecutor's Office is required. The Public Prosecutor's Office will act considering the legitimate interests involved. When the victim is a minor, a person with a disability requiring special protection, or a vulnerable person, a complaint from the Public Prosecutor's Office will suffice.
2. In these crimes, a pardon from the victim or their legal representative does not extinguish the criminal action or the corresponding liability.
