1. The aforementioned conduct shall be punished, respectively, with prison sentences of two to eight years for the assaults under Article 178.1, five to ten years for the assaults under Article 178.3, seven to fifteen years for the assaults under Article 179.1, and twelve to fifteen years for those under Article 179.2, when any of the following circumstances apply:

1. When the acts are committed by the joint action of two or more persons.

2. When the sexual assault is preceded or accompanied by extreme violence or acts of a particularly degrading or humiliating nature.

3. When the acts are committed against a person who is in a situation of special vulnerability due to age, illness, disability, or any other circumstance, except as provided in Article 181.

4. When the victim is or has been a spouse or partner in a similar relationship of affection, even without cohabitation.

5. When, in committing the crime, the perpetrator has taken advantage of a situation or relationship of cohabitation, kinship, or a relationship of superiority with respect to the victim.

6. When the perpetrator uses weapons or other equally dangerous means capable of causing death or any of the injuries provided for in Articles 149 and 150 of this Code, without prejudice to the provisions of Article 194 bis.

7. When, in order to commit these acts, the perpetrator has overridden the victim's will by supplying them with drugs, medications, or any other natural or chemical substance suitable for that purpose.

When the description of the typical offenses provided for in Articles 178 or 179 takes into account any of the aforementioned circumstances, the conflict shall be resolved in accordance with the rule in Article 8.4 of this Code.

2. If two or more of the aforementioned circumstances are present, the penalties respectively provided for in paragraph 1 of this Article shall be increased by half.

3. In all cases provided for in this chapter, when the offender has taken advantage of their position as an authority, agent thereof, or public official, the penalty of absolute disqualification from holding public office for a period of six to twelve years shall also be imposed.
