1. Anyone who harasses a person by persistently and repeatedly engaging in any of the following conduct, without legitimate authorization, and thereby disrupting the normal course of their daily life, shall be punished with imprisonment for three months to two years or a fine of six to twenty-four months:
1. Watching, stalking, or seeking physical proximity to them.
2. Establishing or attempting to establish contact with them through any means of communication, or through third parties.
3. Using their personal data improperly to acquire products or goods, or contract services, or cause third parties to contact them.
4. Infringing upon their freedom or property, or the freedom or property of another person close to them. When the victim is in a situation of special vulnerability due to age, illness, disability, or any other circumstance, the penalty shall be imprisonment for six months to two years.
2. When the victim is one of the persons referred to in paragraph 2 of Article 173, a prison sentence of one to two years, or community service of sixty to one hundred and twenty days, shall be imposed. In this case, the complaint referred to in paragraph 4 of this Article shall not be necessary.
3. The penalties provided for in this Article shall be imposed without prejudice to those that may correspond to the crimes in which the acts of harassment were committed.
4. The acts described in this Article shall only be prosecuted upon complaint by the aggrieved person or their legal representative.
5. Anyone who, without the consent of the owner, uses a person's image to make advertisements or create fake profiles on social networks, dating sites, or any other means of public dissemination, causing the person to be harassed, stalked, or humiliated, shall be punished with a prison sentence of three months to one year or a fine of six to twelve months. If the victim of the crime is a minor or a person with a disability, the upper half of the sentence will be applied.
