1. Anyone convicted of unlawful detention or kidnapping who fails to disclose the whereabouts of the detained person shall be punished with a prison sentence of ten to fifteen years in the case of unlawful detention, and of fifteen to twenty years in the case of kidnapping.
2. The act shall be punished with a prison sentence of fifteen to twenty years in the case of unlawful detention, and of twenty to twenty-five years in the case of kidnapping, when any of the following circumstances are present:
a) That the victim was a minor or a person with a disability in need of special protection.
b) That the perpetrator carried out the unlawful detention or kidnapping with the intention of violating the victim's liberty or sexual integrity, or subsequently acted with that purpose.
