1. Anyone who, within the cases contemplated by law, performs an abortion, shall be punished with a fine of six to twelve months and special disqualification from providing any type of service in public or private gynecological clinics, establishments, or offices for a period of six months to two years, if:

a) Without the required prior medical opinions;

b) Outside of an accredited public or private center or establishment. In this case, the judge may impose the penalty in its upper half.

2. In any case, the judge or court shall impose the penalties provided for in this article in their upper half when the abortion has been performed from the twenty-second week of gestation onward.

3. The pregnant woman shall not be penalized under this provision.
