1. Anyone who performs an abortion on a woman, with her consent, outside the cases permitted by law, shall be punished with imprisonment for one to three years and special disqualification from practicing any healthcare profession or providing any type of service in public or private gynecological clinics, establishments, or offices for a period of one to six years. The judge may impose the higher half of the penalty when the acts described in this section are carried out outside an accredited public or private center or establishment.
2. A woman who performs her own abortion or consents to another person performing it, outside the cases permitted by law, shall be punished with a fine of six to twenty-four months.
3. In all cases, the judge or court shall impose the penalties respectively provided for in this article in their upper half when the conduct is carried out from the twenty-second week of gestation onward.
