1. Anyone who kills another person shall be punished, as guilty of homicide, with a prison sentence of ten to fifteen years.
2. The acts shall be punished with the next higher penalty in the following cases:
a) when any of the circumstances of paragraph 1 of article 140 are present in their commission, or
b) when the acts also constitute an offense of assault under article 550.
