1. Once the suspension period has elapsed without the offender having committed an offense that demonstrates the expectation upon which the suspension decision was based can no longer be maintained, and provided the rules of conduct established by the judge or court have been sufficiently met, the judge or court shall order the remission of the sentence.

2. However, in order to order the remission of a sentence that has been suspended pursuant to paragraph 5 of Article 80, proof of the offender's rehabilitation or the continuation of treatment must be provided. Otherwise, the judge or court shall order its enforcement, unless, after hearing the relevant reports, it deems the continuation of treatment necessary; in such case, it may, with due justification, grant a reasoned extension of the suspension period for a period not exceeding two years.
