1. The judge or court shall revoke the suspension and order the execution of the sentence when the convicted person:
a) Is convicted of a crime committed during the suspension period, and this demonstrates that the expectation on which the suspension decision was based can no longer be maintained.
b) Seriously or repeatedly breaches the prohibitions and duties imposed on them pursuant to Article 83, or evades the control of the prison administration's sentence and alternative measures management services.
c) Seriously or repeatedly breaches the conditions imposed for the suspension pursuant to Article 84.
d) Provides inaccurate or insufficient information regarding the whereabouts of assets or objects whose confiscation has been ordered; fails to comply with the commitment to pay the civil liabilities to which they have been sentenced, unless they lack the financial means to do so; or provides inaccurate or insufficient information regarding their assets, breaching the obligation imposed in Article 589 of the Civil Procedure Law.
2. If the breach of the prohibitions, duties, or conditions has not been serious or repeated, the judge or court may:
a) Impose new prohibitions, duties, or conditions on the convicted person, or modify those already imposed.
b) Extend the suspension period, provided that it may not exceed half the duration of the period initially set.
3. In the event of revocation of the suspension, the expenses incurred by the convicted person to repair the damage caused by the offense, pursuant to paragraph 1 of Article 84, shall not be reimbursed. However, the judge or court shall credit against the sentence any payments and work performed pursuant to measures 2 and 3.
4. In all the above cases, the judge or court shall decide after hearing the Public Prosecutor and the other parties. However, the court may revoke the suspension of the sentence and order the immediate imprisonment of the convicted person when this is essential to prevent the risk of recidivism, the risk of the convicted person fleeing, or to ensure the protection of the victim.
The judge or court may order any necessary investigative procedures and schedule a hearing when deemed necessary to reach a decision.
