1. In determining the lesser penalty, judges or courts shall not be limited by the minimum amounts established by law for each type of penalty, but may reduce them as determined by the application of the corresponding rule.
2. However, when the application of the preceding rules results in a prison sentence of less than three months, it shall in all cases be replaced by a fine, community service, or house arrest, even if the law does not provide for these penalties for the offense in question, with each day of imprisonment being replaced by two installments of a fine, one day of community service, or one day of house arrest.
