In the cases provided for in the first circumstance of article 21, the judges or courts shall impose a penalty one or two degrees lower than that indicated by law, taking into account the number and the nature of the requirements that are missing or present, and the personal circumstances of its author, without prejudice to the application of article 66 of this Code.
