1. Notwithstanding the provisions of the preceding articles and when the Code so determines, the fine shall be established in proportion to the damage caused, the value of the object of the crime, or the benefit derived from it.

2. In these cases, the judges and courts shall impose the fine within the limits established for each crime, considering, in determining its amount in each case, not only the mitigating and aggravating circumstances of the act, but primarily the economic situation of the offender.

3. If, after sentencing, the economic situation of the convicted person worsens, the judge or court may, exceptionally and after due investigation of said situation, reduce the amount of the fine within the limits established by law for the crime in question, or authorize its payment in installments to be determined.

4. In cases where this Code provides for a fine for legal entities in proportion to the benefit obtained or facilitated, the harm caused, the value of the object, or the amount defrauded or unduly obtained, if it is not possible to calculate the fine based on these factors, the Judge or Court shall explain the impossibility of carrying out such a calculation, and the fines provided for shall be replaced by the following:

a) A fine of two to five years, if the offense committed by the natural person carries a prison sentence of more than five years.

b) A fine of one to three years, if the offense committed by the natural person carries a prison sentence of more than two years not included in the preceding paragraph.

c) A fine of six months to two years, in all other cases.
