1. The penalty of a fine shall consist of the imposition of a pecuniary sanction on the convicted person.
2. Unless otherwise provided by law, the penalty of a fine shall be imposed using the day-fine system.
3. Its minimum duration shall be ten days and the maximum two years. Fines imposed on legal entities shall have a maximum duration of five years.
4. The daily rate shall have a minimum of two euros and a maximum of 400 euros, except in the case of fines imposed on legal entities, in which case the daily rate shall have a minimum of 30 euros and a maximum of 5,000 euros. For the purposes of calculation, when the duration is set in months or years, months shall be understood to have thirty days and years three hundred and sixty.
5. Judges or Courts shall determine, with justification, the length of the penalty within the limits established for each offense and according to the rules of Chapter II of this Title. Likewise, the court will specify in the judgment the amount of these installments, taking into account exclusively the offender's financial situation, as determined by their assets, income, obligations, family responsibilities, and other personal circumstances.
6. The court, for justified cause, may authorize payment of the fine within a period not exceeding two years from the date the judgment becomes final, either in a single payment or in installments as determined. In this case, failure to pay two installments will cause the remaining installments to become due.
