It is a circumstance that may mitigate or aggravate responsibility, depending on the nature, motives and effects of the crime, if the aggrieved party is or has been a spouse or person who is or has been linked in a stable way by an analogous relationship of affection, or is an ascendant, descendant or brother by nature or adoption of the offender or of his spouse or partner.
